1.  Get medical help and call the police

Your first priority after an accident should be to obtain medical attention for your injuries – or, if you are able, to administer first aid to any other injured victims, regardless of who is to blame.   Next, you must notify the police – you, the other driver or a witness will need to call 911 to obtain immediate assistance.  The police can help secure the accident area and administer emergency aid – and they will also take down the details of the accident so that a police report can be filed.  This is absolutely essential in order to properly document your accident.

2. Contact your insurance company

Once all urgent medical needs have been taken care of, you should notify your own insurance company.  This is not the same as providing a statement to the claims agent of the other driver – this is simply advising your insurer that the accident occurred.

3.  Check your policy for uninsured motorist coverage

If you were involved in a car accident with an uninsured driver and you have an uninsured motorist benefit on your policy, you should be eligible to file a claim with your own insurance company.  However, if the claim is denied or if you don’t have this optional benefit, consulting with an experienced attorney is a good idea.  A lawyer can review the details of your accident to identify if there are other options available to you.

4.  Hold your insurance company accountable – but understand your coverage

Kentucky law states that insurance companies must exercise good faith in dealing with the customers they insure, but legal representation may be necessary to make sure your own insurance company meets its obligation to you.  You should review the details of your policy to be sure you understand what is and isn’t covered.  If you need a rental car after being involved in a traffic accident, for example, your insurance policy may cover the costs of a rental car for a certain number of days – but it depends upon the policy benefit you have purchased.

5.  Avoid providing statements to the other driver’s insurance company

If you’ve been hurt in a car accident, do not provide a statement to the other driver’s insurance company without consulting an attorney –  those comments can and will be used against you.  If you give a statement and then discover your injuries are more severe than you initially thought, you may have trouble trying to get the compensation you need. Remember – the insurance company is looking for a reason to deny or minimize your claim, so don’t give them ammunition by providing information before you understand the extent of your own injuries

6.  Don’t sign documents or accept payment without speaking to an attorney

If the other driver was insured, and that insurance company sends you a check or any form of documentation in the mail – do not sign or cash the check without first speaking to an attorney.  Cashing a check can constitute legal signature of a release – which prohibits you from bringing any legal action against the other driver or insurance company.  Typically, insurance companies will offer the lowest settlement amount that they think you may accept, so you should consult with a lawyer before agreeing to a settlement, providing medical or other records to the other driver’s insurance company or signing any documents.
