Criminal charges come in two classes, you need a criminal defense lawyer in both cases:

Misdemeanors: These are less serious offenses that carry a prison sentence of no more than 12 months. These offenses may include possession of small amounts of marijuana, assault and battery, bad checks, shoplifting, and many traffic offenses. There are two categories of misdemeanors.

  • For a Class A misdemeanor, the term of imprisonment is up to 12 months.
  • For a Class B misdemeanor, the term is up to 90 days.

Felonies: These are more serious offenses for which the penalty is more than 12 months in prison. Examples of felonies include homicide, assault with a deadly weapon, burglary, armed robbery and grand larceny. Many drug-related charges and theft offenses are prosecuted as felonies. Felonies are broken down into five classes:

  • Class D felonies, carrying a sentence of one to five years. An example is trafficking of eight ounces to five pounds of marijuana for a first offense.
  • Class C felonies, carrying a sentence of 5-10 years. An example is forgery.
  • Class B felonies, carrying a sentence of 10-20 years. An example is armed robbery.
  • Class A felonies, carrying a sentence of 20-50 years. An example is arson.
  • Capital offenses, which can result in the death penalty or life in prison.
